Gang Enhancements (California Penal Code § 187.22(b))
This part of the Street Terrorism Enforcement and Prevention ("STEP") Act is supposed to increase the sentences for crimes when they are done "for the benefit of, at the direction of, or in association with" a "criminal street gang."
Gang Membership (California Penal Code § 187.22(a))
This charge is also part of the STEP Act. However, this charge stands by itself, making it a crime to be a member of a criminal street gang. It does not require any additional charges, like the gang enhancement.
Violation of Gang Injunctions
When there is a gang injunction, a person can be charged with violating the injunction. Rick will help defend person accused of violating the injunction.
Misdemeanor and Felony Criminal Charges
Rick also has some experience with and will take all cases involving criminal charges. This includes murder/attempted murder, assault and battery, robbery, burglary, sexual assault, sexual battery and other sex crimes, strike cases, drug cases (sales and possession) and more minor cases such as disturbing the peace, drunk-in-public, etc. In addition, Rick will handle some traffic cases and DUI (driving under the influence of drugs and/or alcohol). Currently, Rick does not handle deportation or other immigration-related charges.
